IMPORTANT: When you receive your shipment, check for damaged or missing items BEFORE signing off with the carrier. Spirit of '76 will NOT be responsible for damaged or missing items not noted on the bill of lading (BoL). Please see Delivery section for more information. 

Online Shopping Terms & Conditions

All orders and purchases made through this website are subject to the Online Shopping Terms and Conditions outlined below. These Online Shopping Terms and Conditions may change from time to time without prior notice, at our discretion.

This website is owned and operated by Spirit of 76 Fireworks, LLC (SO76). All orders and purchases made through the facilities of this website shall be subject to these Online Shopping Terms and Conditions.

SO76 may correct errors or inaccuracies and change or update information on this website at any time without notice, including in respect of prices and availability of items. All prices listed on this website are in United States of America dollars and all charges will be processed in United States or America dollars.

All prices listed on this website are subject to confirmation. SO76 will notify you by email if the confirmed price of an item you have selected differs from the price listed on the website or on your purchase order.

SO76 reserves the right to limit the quantities of certain items which you, your company or any group can purchase. SO76 will use commercially reasonable efforts to deliver items as quickly as possible and within any time periods indicated; however, SO76 will not be responsible for any delays in delivery which are beyond its control. If goods are not available or there is a delay in delivery SO76 will notify its customers within 5 business days.

Goods will be shipped via freight carrier. Once Payment has been received and processed, goods will be shipped, please allow 7-10 business days.

Export Restrictions

SO76 will deliver to addresses within United States of America only. Goods will not be shipped internationally. Goods will only be delivered in states to comply with state laws.

Privacy

SO76 is committed to complying with United States of America legislation governing privacy of personal information by businesses. SO76 is committed to the security of all information associated with our customers. We have security measures in place to attempt to protect against the loss, misuse and alteration of personal information under our control.
Any personal information you provide will only be used for the purpose for which you have provided it and will not be added to any third party mailing lists.

Security

Credit card payments are secured using 128-bit SSL encryption. This ensures all credit card details you send to us via the internet will be encrypted. If any other user intercepts the communication, they will only be able to view the encrypted form. This makes it impossible to be intercepted by an unauthorized party as long as your browser supports the use of encrypted data transmissions.

Fraud Prevention

In order to protect you and SO76 from fraudulent transactions, SO76 may provide your transaction-related information to a reputable third party organization to perform address verification. This address verification is intended to ensure that the "bill to" address that you provide matches your credit card address. SO76 also reserves the right, at its discretion, not to ship items ordered or purchased on this website to certain addresses. Upon delivery SO76 may request the delivery company to check valid form of identity and may refuse delivery if ID does not match recipient named on the bill of lading.

Refunds

Defective items will be replaced, refunded or credited if the customer/recipient follows the delivery instructions below. How the defective items are replaced, refunded or credited are subject to SO76. SO76 will not process Refunds for incorrect purchase or change of mind. All Refund requests need to be made in writing to [email protected] within 7 days of purchase.

In the event that SO76 chooses not to ship an item, you will be notified by email and any amount charged to your credit card will be refunded.

Shipping Policy

  • We only ship within the continental United States of America.
  • We do not deliver goods to where they are illegal to receive in regulation to all local, state and federal laws.
  • Delivery is via third party courier.
  • It is our company policy that we do not ship to Post Office boxes.
  • All deliveries are sent with registered couriers and must be signed for at time of delivery.
  • Shipping address cannot be changed once order has shipped.
  • As the registered couriers are third-party courier companies, we are unable to control their delivery time. 
  • If the delivery is to your home address, someone must be home to sign for and receive the product. If not, we recommend using an alternative, like your work address for delivery.
  • If you are not home at the time of delivery additional delivery charges may apply.
  • Orders cannot be cancelled once shipped.
  • Shipping time may vary depending on your location, please allow 2 -10 days for delivery.
  • Shipping charges are determined by packing size, weight and delivery location.

 

Receiving Information

All Shipments of fireworks are federally regulated and will be shipped only by federally approved means. Spirit of '76 assumes no liability of misuse, illegal sale or illegal transportation by the purchaser. All fireworks are sold on the premise that they will be used or sold in accordance with all local, state and federal laws.

Spirit of '76 requires all purchasers to be 18 years of age or older.  Purchaser may be required to provide identification at time of pickup or delivery. 

Delivery

Please check your freight documents and your order sheet while delivery courier is still present. If there is something wrong with the delivery (damaged or missing cases) it must be noted on the Bill of Lading before signing it.

All damaged or tampered cases must be marked on the Bill of Lading (Freight Document).
All open or missing cases must be marked on the Bill of Lading. All wholesale orders will be shipped on pallets. The merchandise will be wrapped in shrink-wrap. Any orders received with out shrink-wrap or a pallet must be noted on the Bill of Lading.

All of this is necessary because of the expense of shipping and the value of fireworks.  If there are any problems with delivery and they are not marked on the Bill of Lading at the time of delivery, SO76 is not responsible for refunds, reshipments or any type of credits.

Claims 

If an order does arrive with damaged or missing product, it is up to the receiver to file a claim with the courier. Claims may take 4 weeks or more, depending on the company. If you do need to file a claim, please inform us of the damage (with pictures if possible) and the claim number.
